Terms & Conditions – The Joe Residence

Welcome to The Joe Residence, a licensed guesthouse in St. Julian’s, Malta. These Terms and Conditions (“Terms”) govern all bookings and stays at our properties, which are managed through the Lodgify platform. By making a booking (whether directly on our website or via connected channels such as Airbnb or Booking.com in the future), you agree to be bound by these Terms.

1. Bookings & Payments

All bookings are subject to availability and confirmation of the quoted price.
Full payment (or deposit, if applicable) is processed securely via third-party payment providers integrated with Lodgify (e.g., Stripe). We do not store your full payment card details.
Direct bookings on our website incur no additional service fees.
Prices include VAT and the applicable Maltese eco-contribution tax (where required).

2. Cancellation Policy

Cancellations and refunds are governed by the specific policy displayed and selected at the time of booking for each property.
For direct bookings, the cancellation rules shown during checkout apply.
For bookings made via connected channels (e.g., Airbnb, Booking.com), the platform’s cancellation policy prevails.
Any applicable refunds will be processed through the original payment method, minus non-refundable fees (if any).

3. Check-in & Check-out

Standard check-in: from 15:00 onwards.
Standard check-out: by 11:00.
Early check-in or late check-out may be arranged upon request, subject to availability.
Self check-in instructions will be provided prior to arrival.

4. Guest Obligations & House Rules

Guests agree to:

Provide accurate personal information for booking and mandatory registration with Maltese authorities.
Respect the property, furnishings, and common areas.
Keep noise to reasonable levels, especially between 22:00 and 08:00 (quiet hours).
Not exceed the maximum occupancy stated for the booked unit.
No smoking inside the accommodation (permitted only on outdoor balconies/terraces where available).
No parties or events.
Report any damage, faults, or issues immediately.
Comply with all applicable Maltese laws.

5. Damages, Security Deposit & Liability

Guests are fully responsible for any damage, loss, or excessive cleaning required due to their actions or those of their party.
We reserve the right to charge the payment method on file (or request payment) for repairs, replacements, or extra cleaning.
A security deposit may be pre-authorised or charged in certain cases (details provided at booking).
The Joe Residence is not liable for personal injury, loss, theft, or damage to guests’ belongings, except where caused by our proven negligence.
Guests use all facilities (including balconies, terraces, and pool) at their own risk.

6. Penthouse Private Pool & Terrace Safety (Property 601 only)

The private pool and terrace are for the exclusive use of penthouse guests.
Use is entirely at guests’ own risk – no lifeguard is provided.
Children must be supervised by an adult at all times.
No diving, running, glassware, or unsupervised activities permitted.
Guests are liable for any damage or injury resulting from misuse.

7. Service Limitations & Force Majeure

We strive to maintain all amenities in full working order but cannot guarantee uninterrupted services (e.g., Wi-Fi, utilities, air conditioning) due to external factors, maintenance, or events beyond our control.
No refunds or compensation will be provided for interruptions caused by force majeure (e.g., extreme weather, power outages, public health measures).

8. Right to Refuse or Terminate Stay

We reserve the right to refuse check-in or require immediate departure (without refund) if:

House rules are breached.
Behaviour endangers the property, other guests, neighbours, or staff.
False information was provided during booking.

9. Governing Law & Jurisdiction

These Terms are governed by the laws of Malta. Any disputes shall be subject to the exclusive jurisdiction of the Maltese courts.

10. Changes to Terms

We may update these Terms from time to time. The version displayed on our website at the time of booking applies to that reservation.
